They will peeze and moan about this long enough to spend another $100k in legal fees and still lose in court again. The whole crowd wants the tax money to blow but doesn't want Boone to come into the 21st century. Bunch of freeking idiots starting with the ex-mayor

There wont be a lawsuit against the state as the state supreme court was the last word. It appears that there may be a lawsuit against the town by two citizens.

Can the town try to just annex the former ETJ without building water and sewer infrastructure? Then again, I don't know the town wants to annex. It might change the political control of the town. The ETJ area would likely bring a lot more republican voters.

Now that the town can no longer impose their will on people in the county I wonder how that affects the dirt track and the fine that the town charged them.

I don't think so. To make it worse, apparently the county signed on with the legislature to defend the law, and covered part of the bill for the legislature. Talk about when morons attack.

The case doesn't make ETJ's illegal. It establishes that the legislature can over rule a local township.

It would seem that one citizen of an etj could cite the case law from the watauga/boone decision and have it removed without having to sue.

No, at least not automatically. It won't void ETJ's. But it will allow the legislature to overrule towns on ETJ's, and possibly allow citizens in ETJ's to sue for their area to ETJ to be dissolved.

Congrats to all you Watauga county people who live in the Boone ETJ. you are now free from the town. At least with the county you have a vote when it comes to the people who make laws impacting your property.
