a local company is preventing employees from getting a better paying job

I don't know if it is true or not but I have heard from several different people that the someone at the Employment-security-commission is telling people who are denied a job because they work for Vannoys that it is illegal and they should get an attorney.

They went thru a year ago and took options on all the land that could be approved. The land owner gets about a dollar a yard - but Vannoys has the option for three years.

Seeing how vannoy does not own any of the right of ways or property along 221 how in Hades are they selling or offering a place to dump squat?

I'll sell you a place to dump your dirt.

An employment agreement which contains a "non-compete" clause is enforceable under certain situations, if the desired employee with the skill set needed is readily available in the area, and you had provided specific compensation for the signing of the non-compete it could be enforced. I doubt either company has employment agreements with their equipment operators. The quid-pro-quo mentioned for the disposal of excess material makes a lot more sense and could be in a contract which would be enforceable. Enforceable since it would appear to be a fair exchange of value, I'll give you a place to dump your extra dirt if you don't hire my active employees.

The term "head hunting" comes to mind. When a company goes after a competitors employees. It is completely legal, legit, common place etc...

It was my understanding that companies can enter agreements not to actively recruit or poach employees of the other company, but it would be against the law if they posted a job and would not hire someone solely because they are an employee of the other company.

I do know some companies have employees sign agreements not to leave for jobs at a competitor. I also know that they have never been able to stop anyone that did.

To not hire them just because they work for another company would be a labor board violation. The same would hold true if a school teacher could get paid more in Ashe but worked in Alleghany. To not hire them just because they worked in Alleghany would be a violation. A serious one.

It's V&G not V@C - lol

It may have to do with all of the options Vannoys took with property owners that had waste sites along section C

Vecellio & Grogan has to deal with them to get rid of the extra material - about 3 million yards of it

They shouldn't be filtered. They are public companies. Just like I look for the mouth breathers to name the landing strip the Vanoy airport.

For the record, he only had 2 posts to flag, and both were approved. The first one to flag was at 6:52pm yesterday, but since he made a new thread on the topic I had to find a way to fit it in here, so I changed the timestamp to 8:59pm today.

The reason it flagged had nothing to do with the names of the companies. It flagged because he's using a new username, and the system saw the V@C as a potential email address. Posting an email address is common for both spammers and people trying to post a classified in the message board, so we review those manually before approving them.

It's not exactly illegal, since it's just two privately owned companies. It is immoral, but that's never stopped Vannoys in the past. The real shocker is they haven't figured out how to get the county to provide their labor for the 221 job.

After I heard about this I wondered if it was legal or not either way it is dirty to pull such a stunt.

Sounds like the labor board needs to pay a visit to both companies.

Vecellio & Grogan is hiring truck drivers and operators to work on 221 but if you work for Vannoys you are out of luck since they have manage to convince V@C not to hire any of their employees. Maybe they should raise their pay scale to keep their workers instead of playing dirty to prevent them from going to a better paying job.

I see that one of my posts finally got posted.

I know of one person who claims he was offered a job driving a cat 777 dump truck for 20 dollars an hour and when they found out he worked for Vannoys V@C told him that they couldn't hire him due to an agreement they had with vannoys.

If the companies are truly doing that, someone should file suit against them. That is restraint of trade and price fixing.

I can't be more specific since my post was flagged for posting the companies names. But basically company V has made some kind of deal with the contractor doing section C to prevent them from hiring anyone working for company V. Its sad that a local company would play games to keep their employees from getting a better paying job.

There is nothing that forces them to not hire someone. Now, if they agreed to not hire those individuals, that's different.

That is what I have been hearing.
