Well I stand corrected. I had no idea that Roark and that board are stupid enough to even consider putting him in a county job. He couldn't count cars at the dump much less over see a county department. I really am embarrassed to call Ashe county home with the decisions this gang of idiots have made.

Time to request outside help at getting Rose removed from office. Sands is probably OK since his work was voluntary and the vehicle use was work related, not personal. Roark should be removed from church grounds due to his dressing up in sheep's clothing..

Only, if you read the article I posted, it specifically said the Supreme Court had ruled that police officers are public officers, not employees. So the chief of police would not be the same as a night watchman.

FINS, from the article you linked in your original post, the following paragraph seems to indicate that Sands held a legal elected post while serving as an employee (volunteer or not) in the sheriff's department.


Here are two other examples. One case involved a person who served on the Raleigh Board of Aldermen at the same time that he was employed as the night watchman for the federal courthouse under an appointment from the United States Treasury department. The supreme court concluded that while the position of alderman was a public office, the position of night watchman was not. It explained that the watchman was "employed in a specific service having none of the attributes to raise it to the dignity of the constitutional disqualification." Doyle v. Aldermen of Raleigh, 89 N.C. 133, 135�36 (1883).

I'm not speaking to the concerns voiced regarding the potential conflict of interest Commissioner Sands had by voting on his employer's budgets, a potential new boss and the like. Rose may or may not fall into the same category as much as I wish it were not so.

I often wonder, do any of the local reporters know of the UNC School of Government? It exists as a resource for journalists. You pick up the phone, dial the number, ask a question and BOOM, query answered in less than an hour.

I don't think JPP or Roark are smart enough to ever do the research and figure it out. I think they went on the word of the attorney who just said "well, they aren't county employees". But he didn't do any actual research either. The real question one should ask though, can the chief of police serve as sheriff at the same time?

They were afraid of their elected position with the voters of the county to say anything to Sands. Also they were taught in the school that they cant bad mouth a fellow commissioner or question them. It would be sure political suicide to bring it up about Sands.

While it surprises me that Gerry didnt do it as much as he likes to go to court and file useless junk in the register of deeds office.

Actually, the more I look at it, the NC constitution is pretty clear. I am with you Fins, I think you are on to something. The chief of police is essentially appointed by the town of WJ therefore he is a public official. He is the extension of the elected officials.


I still think Sands situation is not as clear, but I understand the logic and have no issue applying it to him as well.

I still think if there were any chance there was a conflict, JPP or Roark would have seized on it long ago. I also think Sands has enough integrity that if he thought there was a conflict, he would have pointed it out himself and stepped down from one of his positions. As for Rose, I used to think he had some integrity. He has disabused me of that notion .

FairPlay, no I don't. The SOG doesn't go through every board and analyze if the members are illegitimate or not. For the most part, they leave it to the county attorneys to answer those questions. But they will give an opinion and information when they are asked. I doubt the subject has ever been asked of them. You can read the article I posted and see how it at least raises a good reason to question their legitimacy.

What's interesting is so far no one has tried to dispute the article or post info that would give either of them exemptions.
