There may be a strong argument, how often has it been held up in court?


I know its from the internet but there is a decent description of 4th amendment applications for traffic stops and checkpoints. For checkpoints a lot depends on the intent of the checkpoint.

There is a strong argument that traffic checks conducted for reasons other than looking for a specific individual or car (due to criminal activity) is a violation of the 4th Amendment's protections as they are conducted without a warrant.

Being a privillage doesn’t mean it trumps the right to privacy. It means they can revoke your privillage IF you break the law. They don’t get to harass you before then.

I remember from drivers education operating a motor vehicle on a state maintained highway is a privilege not a right, I guess the state and all her agents are within their rights.

Why would I antagonize them I don’t have a problem with traffic checks. Not at all, I just feel like my minor inconveniences at a traffic check are outweighed by the public good.

FWIW,

I've never understood the complaint with traffic checkpoints, I never have an issue when I go through them mainly because I have a valid drivers license, my vehicle is legal (insurance, proper tags etc.), I don't drink and drive and I don't carry dope in my car, so I don't see the complaint. I do however know what it's like to be hit by a drunk driver and I also had an uncle killed by a drunk driver (back before it was considered a crime). My thing is if their checkpoint keeps one family a year from loosing a loved to a drunk driver, then the law should do more of them.

If you google checkpoint grants, you’ll find there are a lot of links that come up about federal funding for checkpoints. The first one is even from MADD

Past experience tells me FINS is always right. If that is why the sheriff is doing the roadblocks, then he should say so.
