JEFFERSON �" Mickey Boyles has agreed with the Ashe County Sheriff’s Office to purchase the Ashe County K9 Unit Nyla Jean.

Boyles, a former deputy and the dog’s handler under former Sheriff Terry Buchanan, expects he will have to pay the $5,000 asking price for the dog.

“Ultimately I’m going to buy her. I don’t want her ending up at the animal shelter,” Boyles said. “I’m sure I’m going to have to pay the full price.”

Nyla Jean, a 3-year-old dog, has been in service for the last two years before her pending sale. The dog was originally bought by the Ashe County Sheriff’s Office using money raised by community members.

Ashe County Sheriff Jim Hartley is against taking the dog back, but is also against just giving the dog to Boyles, as was Boyles’ original request.

“Personally I don’t care for the dog,” Hartley said. “The reason I’m against giving the dog to (Boyles) is that I feel that it is county property, and I don’t want to see the county lose money. I know that people that work with dogs get attached to them but that’s beside the point, the dog belongs to the taxpayers.”

Boyles said he originally attempted to return the dog on on Feb. 19, but, according to Boyles, Hartley told him that he “didn’t want the dog” and to “hold onto her” until the county commissioners made a decision.

“It boils down to, if Hartley will agree to the terms that (County Attorney John Kilby) has drawn up then I have agreed to buy her,” Boyles said. “I feel like it’s really juvenile to be argumentative over $5,000 when the county has given out raises over the last 30 days. It feels like a personal attack on me and my family.”

Boyles was referring to the various increases in pay for sheriff’s office employees approved in the month of February after the appointment of Hartley.

County Manager Sam Yearick said that the current discussions regarding Nyla Jean center on reimbursing Boyles for the care of the animal between when he left the sheriff’s office in February and the present date. The board of commissioners voted previously to reimburse Boyles for care of the animal during his time in the sheriff’s office on Feb. 5.

“The biggest thing here is that we all agree that the sheriff doesn’t want the animal and that Mickey does, and the only question is working out the logistics and we’ll get there,” Yearick said.

Should Hartley decide against selling the animal, the dog is able to be retrained to work with a new handler. Hartley said that had already been in touch with someone that can do the retraining, saying that it would cost the county "approximately $1,500" to retrain the animal.

The K9 is currently in possession of Boyles at his home in Yadkin County.

Hartley had rather see the dog euthanized than give it to someone because its the tax payers money the taxpayers have to keep it up in the shelter and then euthanize it if not adopted . but wait I bet Mr Boyles would be exempt from being able to adopt it .politics politics politics

It's a Sheriff issue, not a commissioner issue... But, what if he has taken the dog back to Yadkin County where our deputies have no jurisdiction? Then what?!?

That is exactly what he did the dog is with him in Yadkin county. What needs to happen is what aFic. said a warrant for his arrest for theft of county property needs to be issued and have him arrested. If I am not mistaken the dogs value makes it a felony

The cost of the dog is irrelevant if your saying the dog was stolen. Larceny by employee is a felony in any amount.
However since he is no longer an employee it has become a civil issue since the Sheriff told Bowles to take the dog home and that he didn't want the dog.
