Asphalt Plant Permit Issued

I just read Pat Consadine's letter to the editor in the Ashe County Line. He acts like there has not been an asphalt plant producing sometimes thousands of tons per day for 42 years......in the New River Valley. To my knowledge, there has never been any pollution associated with this plant. Since I live within sight of it, I think in nearly thirty years I would have noticed if I had reason to complain. I think this plant is also less than 1 mile up hill from the New River. I do not see any court banning one company from operation when another company has successfully operated under the same ordinances for 42 years. Let's not let the tail wag the dog any longer. It is a waste of tax dollars.

I have lived by the asphalt plant for 28 years, and haul asphalt on a daily basis. i have no issues at all with asphalt plants. Matter of fact, I enjoy driving on paved roads!!!

I have lived within sight of Ashe County's largest asphalt plant for nearly 30 years. Mr. Clod does too. If there were any problems I would have built elsewhere. It's not like I do not have property in other parts of the county. I like the view from my house.

Pat failed math. Pat failed a lot. Watauga has thrived as a tourist county with anasphalt plant right along the main path to the next tourist town and at the same time next to wild life trout waters. Pat not only failed. But is a complete liar.

Pat says "350 million tons of asphalt a year" He has no idea what he is talking about.
200 ton per hour would be average - about 8 hrs a day - 24 days a month - 9 months out of the year. This assumes they got all the pavement in Ashe County. They will not.
200 x 8 x 24 x 9 = 354,000 tons per year That is a lot different than 350 million tons
Its amazing how facts make liars out of people.

I can't help but wonder the obvious.....What is the REAL reason to deny the building and operating of the asphalt plant?
The environmental angle has been largely debunked.

Hence the reason they are keeping their mouths shut and meeting in secret. They are doing it for pure political reasons. One must figure out who has the power that is pushing them and working the strings.

Sadly it will take a miracle at this point for Sands and McNeil not to be reelected.
Heck even Foxx will, if only the people that showed up and voted for her in the primary show up and vote in November, even if all the Democrats that participated in the Democrat primary showed up and voted for Adams, Foxx would still win....

Or, another way to look at it, if they were awarded court costs, could they then sue for loss of income? Then the insurance company would likely try to settle to save money.

Seems to me though that the reason the plant isn’t built and operating is because of the commissioners. It seems if their reasons were political, that would be malice wouldn’t it?

AMG would have to prove that the County acted with malice, and that their claims were specious and not brought in good faith. Even then, Federal Judges are loath to issue such an order for a plant that is not built and operating. If AMG had the plant up and operating, and the County made them stop, then yes, Ashe County would most likely be forced into issuing bonds to pay them. And the interest rate would be much more than 3 or 4 percent.

The Planning Board conducted their decision making process in accordance with the law. They correctly issued the permit, in accordance with the law. The county BOC, being largely comprised of political cowards and sycophants, did not follow the law. If a Judge finds that they conducted their decision making process in bad faith, or for purely political reasons, the Judge could award the asphalt company and their attorneys all court costs and attorney fees. If the asphalt company attorneys were to decide to remove the issue to Federal District Court, the County will surely lose in a quick and decisive manner. And you can bet Appalachian Materials Group will ask for, and receive costs and attorney fees. The BOC can sometimes operate in a purely political manner. If they follow accepted practices of good governance. And that is something Ashe County has been missing for several years. Good Governance is an unknown factor in Ashe County. It is something we hear about in other places, but something we rarely see.

I always thought Republicans were pro business while Dems were the strict environmentalist. Our BOC is supposed to be entirely Republican....what gives?

Well Daylan you for sure have asked all the questions we wish we could get answers to. Maybe they try and drag this out until all of them are out of office and who knows? They are afraid to talk about zoning for the same reason as the plant perhaps.
