While I understand the references in the article, they all seem to specifically apply to the sale of liquor by the drink, vs. Malt beverages and unfortified wine. At the time the question was asked the scenic byway designation had not been approved, I wonder if a slightly different question would yield a different answer now.

According to that guy that tried to open one in deep gap across from wild cat flea market several years ago, the answer is yes. But he gave up because of how much the locals fought it. The thumpers, including the sheriff at the time, showed up in an organized protest

Can someone do some research and see if we can throw in a topless joint on a scenic byway or the parkway?
I just love those hidden jewels that pop up like this every now and again.

Yep, that's all it takes. Thr thumpers usually miss this because it slides through so quietly. Everyone things "scenic byway" is a good idea until they find out later what restrictions it also puts on their property.

From my understanding, it's already a done deal. With the advent of Hwy 194 being declared "scenic" it qualifies some establishments (read Pie in the Sky) to sell beer without further approval. Heck, it worked for the Vannoy's and their proximity to the Parkway.
