Lumpy, did you miss the part about legally defined? Would you like to know what legally classifies bourbon? I. 1964 congress passed the law defining bourbon as a distinct American product a s established the qualifications for what is bourbon. Those are, it must be made in America, the mash bull must contain 51% corn, it must be aged in new charred oak barrels, it must not be distilled over 160proof and must be bottled at 80proof or higher. If it is labeled as straight bourbon, it must be aged a minimum of two years.
The only federal legal definition of Tennessee whiskey was established in NAFTA and is "a straight bourbon produced in Tennessee". The legislature of Tennessee did establish a more strict definition, but they still include the same requirements as bourbon. The state of Tennessee added that Tennessee whiskey must be made in Tennessee and must be charcoal filtered. I want to say they also added that the water must be limestone water, but can't remember for sure.

Tennessee whiskey is straight whiskey produced in the U.S. state of Tennessee. Although it has been legally defined as a bourbon whiskey in some international trade agreements, most current producers of Tennessee whiskey disclaim references to their products as "bourbon" and do not label them as such on any of their bottles or advertising materials.

No discerning American whisky drinker drinks bourbon that's why we import so many different brands of scotch, and most of the scotch brands they export to the USA the scots refer to as piss water. So we're not even very discerning where scotch is concerned.
