I'm sure he isn't the only one either but for entirely different reasons. He stays with his mother while he's here in Ashe because he doesn't want to buy a house and pay into the economy here. What we have is a manger who is vested in another county intellectually, financially and physically and who could care less if Ashe gets run into the ground as long as he has his big fat salary and bennnies coming in.

No county employee is required to own property. Do you not think there are plenty of employees that rent?

I'm sure he's not the only one that doesn't pay property taxes.

An additional $3,400 in taxpayer money to a person who does not even pay taxes in Ashe County - that's just ludicrous.

I don't see anything in this contract that requires his to "move" or change his place of residence to Ashe County. the way I read it is that if he chooses to relocate then he gets $3,500 for doing so and if he has not officially relocated his home, it appears he can still soak the county for another $3,500.

Does anyone know the amount or percentage of an employee's contribution to the retirement fund? I'd like to know what that adds to his benefit totals...

Plus the county is paying both the employer and employee contributions to the retirement fund. This is a contract easily worth $115,000.00 a year. If we are giving him $600.00 a month in car allowance, I do not ever want to see him driving a county car.

Thats one of the most loose contracts I have ever read. It really does not say the manager has to reside in the county. He does not own an inch of property in Ashe county.

I agree with bear, the current group of mouth breathers only wanted to show their power to a new board.

NORTH CAROLINA
ASHE COUNTY
EMPLOYMENT AGREEMENT
This Agreement entered into this the 2nd day of December 2013, by and between
ASHE COUNTY (First Party) and SAMUEL YEARICK (Second Party).
WITNESSETH:
That Whereas, the County wishes to employ the services of Samuel Yearick as
County Manager; and,
Whereas, the County and Samuel Yearick have agreed to the terms of his
employment inclμding salary and benefits on the following terms and conditions:
1. This Agreement is made and entered this the 2nd day of December 2013, by and
between Ashe County, North Carolina, a body politic, hereinafter referred to as the
County and as the First Party and Samuel Yearick, Second Party, both of who understand
and agree as follows:
2. Effective Date: The effective date of Yearick's employment shall be December
2, 2013.
3. Salary: Yearick shall receive as a starting salary the sum of $85,000.00 and
group health insurance coverage for himself. In addition thereto, he shall be paid the sum
**** 3,500.00 to cover moving expenses from his current home. The County shall also
allow transfer and accept as its responsibility his accrued sick leave from his previous
employment. The annual compensation of the Manager shall be reviewed annually on or
near the anniversary of employment and the Board of Commissioners shall review the
employee's performance to determine annual salary increases.
The County/Employer agrees to pay the Employer's contribution to the public
employees' retirement system and in addition thereto agrees to pay the Employee's share
of any required employee contribution ..
4. That the term of Yearick's employment shall be a period of four ( 4) years. In
the event he shall be involuntarily terminated prior to the expiration of that term, he shall
receive severance pay in an amount equal to one year of his then paid salary plus one
year of insurance coverage and all other accrued benefits to which he is otherwise
entitled.
5. That Yearick's duties and responsibilities shall be as set forth in the job
description (a copy of which is attached hereto as Exhibit "A") for the County Manager
plus any additional duties that the Board of Commissioners may request that he assume.
His minimum work week shall be 40 hours plus any additional work reasonably
necessary or required to discharge the duties and responsibilities of Manager.
6. That during the tern of his employment, Yearick shall not hold any outside job;
he shall hold no political office and shall not be involved in any political activity other
than may be necessary to further the interests of the County and only then at the
expressed instruction of the Board of Commissioners.
7. Vacation and Sick Leave: Vacation, sick leave and other benefits shall be
determined as is set forth in and by the County personnel manual.
8. County Manager is required to have a car available for County business. The
County shall supply an appropriate vehicle, which shall be used for County business.
Provided that such vehicle may be used for limited personal use, and provided further
that the Manager shall reimburse the County for all out of town personal travel at the
County standard mileage reimbursement rate.
9. That the County shall defend, save harmless and indemnify the Manager
against any tort, professional liability claim, demand or other legal action, whether
groundless or otherwise arising out of any alleged act or omission occuring in the
performance of his duties as County Manager.
10. The County hereby agrees to budget for and to pay the reasonable travel and
expenses for professional and official travel, meetings, and occasions adequate to
continue the professional development of the Manager and to adequately pursue
necessary official and other functions of the County.
11. The text herein shall constitute the entire agreement between the parties and
the agreement shall be binding upon and nearer to the benefit of their heirs, successors
and assigns.
IN WITNESS WHEREOF, the Employer and Employee have signed this
Employment Agreement the day and year first above written.
This instru1nent has been preaudited
in the manner required by the Local
Government Budgel & Fiscal Control Act.

Unless the county manager has been working for county government long enough to be eligible for retirement based on years worked and age (vested in the system), he will not receive health insurance for life. His new contract extension is nothing short of the present three wingnuts voting to impose their will on the oncoming BOC. If he's fired by the oncoming BOC, which most everyone assumes will be leaning more toward the Sands/Rhodes part of the board, they will have to pay him for the remainder of his original contract and the additional two years salary plus two years of paid health insurance. That, of course, would make any BOC appear to be poor stewards of our funds to force a buyout of his contract. If he's found guilty of wrongdoing, I would assume that would be void, but that's an assumption. There's usually a clause in contracts that cover wrongdoing and criminal activity related to firing someone. Not only did he receive the contract extension, but also got a $7,200 per year pay raise when you figure in the car deal.

Again, do you have a link to that report instead of just saying it is so? I feel like we covered it before and found the life long insurance wasn't true.
