Thats exactly what will happen about 2 years from now. About 50 grand
My question is was this evidence available when the sbi and the district attorney looked at this case or did both sweep it under the rug and hope it just went away? I assume they are still working since they have not been charged with a crime.

Since they are sued individually, do we taxpayers have to pay for their legal representation? Hope they had umbrella coverage.

Point, this has been a growing problem with law enforcement. They claim the risk to them justifies no knock warrants, or even knock once and kick the door in. It's also been the leading factor in law enforcement shooting pets and innocent people, as they have screwed up and raided the wrong homes

Looks like some sloppy work. Not sure how far this will go, but its at least worth a jury hearing the evidence. I feel sorry for the loss of Mr. Houck's life. However, ignorance to the law is no excuse.

You are missing the point dumper. He was on his own property. The "why" he was doing what he was doing is nobody's business. Smart? Certainly not. Legal.....probably.
And I think this is the first time I've heard the story told from dufuss' side of the fence. If the cops snuck in unannounced and in concealment, maybe my idea of dufuss' actions might need reexamined.

Someone please tell me why a legally blind man was out walking the dog in the dark, and furthermore why was said legally blind man carrying a rifle? I don't see this case going to far!!!

The lawyer might be on to something with the 4th amendment rights. Read up on Castle Doctrines (a man's home is his castle), the origin to them, and the controversy over no knock warrants.
That said, they walked up and cousin doofus pointed a loaded gun at them.the subject of trespassing was recently discussed on GW and explained that in NC, the law says that just being on someone's property doesn't constitute trespassing. So, even if he didn't know who was approaching, he still didn't have any right to threaten them with a loaded weapon.
