Well of course that is true. However, my original reply did not even mention plea agreement. Now, did it? I stand by my original reply a person can plea to guilty or not guilty without the permission of the DA.

No but the DA determines if a plea bargain is acceptable to the state. But the presiding Judge has the final say so and can choose not to allow a plea to a lesser offense

The DA cannot tell a person if they can plead guilty or not guilty.

This does happen many times. However, I believe the defendant can plead whatever they wish. It isn't up to the DA.

Wrong The DA prosecuting the case determines if a plea arrangement can be reached. And has to sign of on any plea bargain before it is taken to the judge who determines whether or not it is acceptable to the court
