As Public Information points out it is highly likely that the DoT will file a request for a change of venue and no doubt the newspaper article will be used as evidence of local bias. Thus it most likely will be tried somewhere other than Ashe ( or Alleghany, Wilkes or Watauga I suspect as well).
I did read the article, the problem here is you have people that have been dragging their feet far to long. I don't like eminent domain, but in most cases of it the government wins. The other solution is they do what they did when they widened 421, they just go behind a bunch of businesses and homes and essentially cut them off from the main road.


How about telling us what business were cut off from the main road.

It's my understanding that the Phillips property is under consideration; however given what I've been told, that department has more than enough enough money in their bank account to do an outright purchase and should have done so a year or so ago and should have already had plans drawn up and a new facility started.

Mr Clod, you are looking for people that can see into the future. I think you should try the carnival when it comes to town. Good roads help everyone - those trying to come to Ashe County and those trying to escape from Ashe County.

Hundreds of people drive 221 every day to work in Boone and Wilkes. They pay their taxes and want a better road. It's that simple.

No, because those industries were outdated for the most part. However, it will go a long way to keep GE in Ashe now. That is not a guarantee but it will make a difference.

Look how hard the fire club has worked to find a new piece of land, settle with the dot, build a building and yet they continue to have a 9 iso rating. Anyone else see why they are still a 9?

Here's a link to the " hired guns" the DOT is using on this section of US 221. They not only designed the road, but are doing the negotiations for all right of way. Later they are going to be supervising the construction along with the dot.

Condemmnation is just a part of the process. V&M does the work up to that point, then the DOT right of way office steps in. Lots of property have been condemed on all sections. Some people have continued to use their property over a year afterwards. You have not seen, and will not see, the sherrifs office dragging people out of their houses. ( firehouses included ).

I am surprised that the fire departments lawyer would want this in the newspaper. A sharpe DOT lawyer would move for a change of venue the first day.

Well the Fleetwood Fire Department has know for a year this was coming. They should have presented counter offers, hired an attorney or called their Representatives months ago. I'm not a big fan of eminent domain, nor am I a big fan of the 4 lane to no where as I like to call it, but ultimately to many people want it for the VLFD to stop it. Keep in mind that while courts often follow what's called precedent they don't have to, and they can rule however they wish according to their interpretation of the law. The problem is that they admit there is a property within their district that meets their requirements, the old Fleetwood school. Admitting that to begin with is like putting a firecracker in your closed fist.

I see you are talking about something for which you have no clue about. If you would have read the article you would know that they do have an Attorney. Also how do you know that they didn't call their Rep. or that their attorney didn't make any counter offers. As for your statement of the road to no where I can see that you don't travel on 221 very much or you would know that the road needs to be up graded due to the amount of traffic it carries.

Please explain how talking about the only piece of property that fits their need is going to hurt them never mind that the property is own by the Ashe county BOE. and if I'm not mistaken is not for sale and is leased to the county for a community center.

If you think that the citizens of Ashe who sit on the Jury will back the state over a FD I think you are on drugs. Someone on that jury will be related to or know someone who will be affected by this and will vote for them and not the state.

If they were smart they would buy the property owed by John Phillips and build there.

I got a feeling the hose jockeys are going to likely hold up the road. The dot should have realized that they couldn't move anywhere until they had the money to buy land and build a building. Jordon and the rest in Raleigh need to get their clowns in line at the dot. There have been rumors that they have a piece of land but cant do a thing until they have the money.

They have a private appraisal. It is arranged by their lawyer. If you are involved in a DOT taking and hire your own appraiser, and it goes to court, the DOT can use that appraisal if it was lower than theirs.

My having your lawyer take care of it they can not use the work product from it.

Well, right there is something else they could have done. Jordan isn't good for much, but they could have called him and got some help too. I know a lot of people that have made good money on ROW purchases over the years.

aFicloNadoS you and I generally are on the same page but we will have to agree to disagree this time. After having dealt with the DOT myself on this project I can't fault the FD. I tried and tried to work with them to no avail but with in a week of calling Rep. Jordan I had 3 state people show up at my house to work things out which required a redesign of mine and my neighbors driveway across a slope. The DOT has a our way or no way attitude with the people but changes very quick when someone gets a call from someone's Rep.
