Actually, case law is very clear. And having your own appraisal when condemnation comes does help. It would also help find a new location and tie it up based on contingency.

Sounds like they may need to find a open field and purchase a Quonset hut..

There's a lot they could have done. They could have found a location and put it under contract. They could have gotten their own appraisal for negotiations. There are many things that could have been done, but my understanding is they've done nothing but sit and wait for the DOT to come back with more money.

How do you go about finding a place when you don't know how much money your going to get? As for the part in red that wouldn't have help since they have case law on their side already the DOT is just be hard to get along with. Remember its not just the FD they are screwing over there are people from one end of the job to the other. I don't understand why the DOT isn't responsible for find them a place to move to since they sure didn't have a problem getting ROW for the gas and Power company's.

I'm not sure what else they could do except just take the low ball DOT offer.

I didn't say the DOT is faultless. But I'm pretty sure the hose jockeys could have been more proactive in the process.

Finding a new location means nothing until you have the money as someone who has and still is dealing with the DOT over this project the fault doesn't lay with the fire chief. Getting things done or getting a fair price or info from the DOT is a joke. The DOT knew that the FD would need to move and you know that the DOT lawyers knew that the law in this case a court ruling back the FD and yet the DOT decided to low ball them on the price and then only give them a month to get out what a joke.

They are doing this to everyone I know one person who had their property and business value comp. with a place in Lansing which is also a joke since there is no place in Lansing that compares to a location On 221 in the Fleetwood/Deep Gap area.

They have even had people house's that the DOT didn't own slated to be torn down

Actually, you should be kicking the chief hose jockey's ***. They have known the road was coming and have done nothing to find a new location. They have been dragging their feet and saying "oh, they can't shut down a fire department" thinking they could do whatever they want. Well, looks like the DOT attorneys found a way around that.

Everyone in the Fleetwood area should be calling our state Rep. and the county commissioners about this since it looks like we could be with out a Fire Dept. for a while. Lets not for get that is a service for which we are required to pay taxes for.

Junior - you might want to read the article from the paper. It's in the link below.

Since they've already been condemned and given an eviction notice it's probably to late for court action.

They have known for years this day was coming. If there is a court case like Hansen says then what is the problem? File suit.
