OK JackEarl - its a Civil Action because it filed by attorneys as a tort remedy. Not one by a DA or Attorney Genera. Torts as Civil Actions - relief sought by one party against another. You selling fake jewelry could cause someone to seek a civil action against you as a remedy for their loss. If they fail to comply on a FOIA request they can be sued - not but in jail. There are cases where civil actions can be criminal - such as gross negligence. Example = Your gross negligence of a known safety hazard causing injury to a person could result in both civil and criminal actions.

Maybe with the lack of cooperation on the records request several commissioners and county manager Sam Y will be charged criminally and the county will save some money on Sam Y BS deal he and that crook G Roark got by everybody's nose! Time will tell on u!

aficianados, you don't seem to see the conflict in your statement.. you admit what Sands was doing was wrong, but still believe it wouldn't cloud his judgement at voting time. Human nature doesn't work that way.

I've always made my opinion clear that I thought Sands working as a deputy, even for free, and serving as a commissioner was a conflict of interest. The same as I think Rose serving as a commissioner is a conflict of interest, because the commissioners can control money that the towns get. See the lawsuits between Boone and watauga over sales tax distribution. Now that Roark is a county employee, he is clearly also in conflict. But based on their voting records, Sands has shown to be the most up and up of the three.

Butterknife, to try to call Sands and Rhodes the corrupt ones shows how stupid you are. First of all, it's pretty much impossible for the two that vote in the minority to be corrupt and get things their way. Second, no one is more corrupt than a commissioner that gets himself hired as a full time county employee.

Its a fact that WBTV knows all the emails, texts. instant messages, were not turned over. Its a fact that they know of contracts between the county and roark. Its a fact that they know rose used his personal phone for county business and its a fact that the redacted emails they did send were done so without warrant.

WBTV knows they have a story now. Even if there is nothing wrong, Bufurt not turning over requested information makes it a story. So now there are two ways this can play out. Either something crooked happened, or Bufurt is clearly a tyrant that doesn't believe in democracy and refuses to cooperate. It's a story now and WBTV won't let it go.
And let's be honest, it's the sheriff's office, not the CIA. They don't have classified secrets.

You fools have no clue about the facts surrounding the WBTV News harassment of Ashe County Officials with ridiculous bogus public information requests. When you do get some factual information come on back here and have an informed discussion with some serious people. I'll tell you one thing for sure. Sorry B*****d Wm. I don't think WBTV would attach a letter giving specific emails and text with missing information, get real Bufort and the three stooges are trying to cover up somethig. And now with the defiance of the order for public records request the county could face another lawsuit. Good job!
