lawyerman, It sounds like you know quite the details. You are correct when you state that the burden of proof is less in a civil vs criminal case. However, Hendrix will have to prove loss here! Loss financially or otherwise. It’s my understanding that he did lose his job as Chief of Police for Ashe Memorial Hospital. Was this due to Rose or the supposed Obstruction of Justice? I don’t know, but I would venture to say that it is all connected in some fashion. I personally don’t think Hendrix is guilty of anything except standing up for himself. This mess has all stemmed from his bid for Sheriff. Yes, the alleged Obstruction of Justice is a result of Hendrix desire to be Sherrif and led by a proven Corrupt Sheriff. I don’t believe any of this would have fallen upon him, if he had not had aspirations of serving Ashe County as Sheriff. I am not aware of a single case where a charge was pursued from a suicide. Feel free to correct me if I’m wrong. I don’t know Hendrix or any of the parties involved, but it’s not very difficult to see what is going on in small town politics. You have a corrupt Sheriff (at the time) that wants no competition in the upcoming election, so he calls for Hendrix to be charged for “Obstruction of Justice “. For those of you that don’t know the law, this is what they charge you with when they can’t come up with a legitimate crime. I do know Bill Brown and for Rose’ sake, it was most likely a good decision to take warrants and make some other officer arrest him. Rose probably would not have faired to well in that exchange. Bill is a good man, but he will not be bullied by the Police or anyone else and it seems that Hendrix has taken the same strategy. All of this is unfortunate for the citizens of WJ, as they will bear the burden with their tax dollars, most likely in both cases. From what I know, Hendrix has had a long honorable law enforcement career. It is sad that a man such as this has to suffer due to the incompetence of the Town, Rose and a corrupt Sheriff!

Remember that there is a burden of proof for Hendrix. The burden of proof is much less in a civil case than a criminal case. Looks like Hendrix may have a good case here and the Town will be forced to settle his case in some manner. In my view, it is time for the Aldermen to take this seriously and take action against their Chief of Police. Taking in consideration the Hendrix case and the looming William Brown case, it is the perfect opportunity for the Town to take action against Chief Rose. The Chief position is very political and he really isn’t in control of anything except himself. It appears that he cannot even do that. ( Control Himself). It is obvious that Chief Rose is certainly weak. This can be substantiated with the Brown case. If Rose is so incompetent that he cannot make an arrest when a “crime “ has been committed in his presence, then how can a reasonable person believe anything he contends? Very poor judgement on his part, in the Brown case and it appears very poor judgment in the Hendrix case as well. Stephen Shoemaker, Calvin Greene, John Reeves and Dale Baldwin, wake up! It is your responsibility to take notice here. Rose is a liability to the Town and it’s citizens. What does Rose bring to the table? Nothing, except liability. It is very obvious that he is not liked by your citizens and you should be taking a good look at his character. How does he handle his personal life? How does he handle the business of the Town? It is pretty evident that the answer, is not to well!!! Hendrix will most likely get some sort of settlement here and Brown may as well. I sincerely hope you Town aldermen take a good look at the quality of Chief you choose to employ.

Rose is such Puxxy that he doesn’t arrest Mr Brown and get warrants so the Sheriff has to go and arrest him! Either he questioned his authority to make the arrest at the time of the committed crime or he was afraid of Mr Brown or he knew he didn’t have enough to make the arrest, Either way, another liability for the town and possibly another lawsuit for us residents to bear! Time for Rose to go! We can’t afford a Chief like Rose!!!! We will most likely have to settle the Hendrix suit and pray that Brown or his employer doesn’t sue!

Thanks s Chief has been a joke and a liability from the day he started! Name one positive thing that he has done for the town! You can’t! It’s time for him to go. This will be another tax increase for us residents. We can’t afford a Chief like this. When will the aldermen wake up? The fact that Hendrix served us with honor and simply left for a better position and now his name gets drug through the mud because of Rose. It’s time for action!

I agree. The plantiff would probably be content seeing him fired. someone that has spent his whole career messing with people leave not only the county business aside, the town of west Jefferson, and hopefully move out of the county the ultimatum. Maybe with him gone that town can have a higher respected police department, not one that has been rubbed in the mud and laughed at because of a joke.

As useless and dangerous as Rose has proven to be, the town is probably in a delicate position. If they fire him, it could be an admission of guilt. Although, I think they would be better off to fire him and work out the settlements. I think the parties involved would be partially satisfied in his being terminated.

Can anyone state any redeeming factor that he has ever done? Or better yet can you name a single person that likes him? What a joke

Rose's time has come. This POS has done nothing but cost this county. No redeeming factors. Fire him.

Their only initial option going into this lawsuit, advise Rose he can resign or forcefully be terminated.

Maybe if they cut him loose their insurance wont be too expensive.
