As for evidence it was evident that a county deputy assaulted a member of the press who was taking pictures at a public meeting. If we take this bit of evidence then it's not a far stretch to believe that the Sheriff as well as others in the County Administration have resisted FOI. It's also well documented that he started investigations of County Employees seeking to follow the law on FOI as documented by the Sheriff himself in interviews with the press.....

Mickey and Ricky could be facing more serious charges like a false arrest and trying to intimidate someone to lie as a witness. They may also be looking at destroying evidence because at least one case file has turned up empty because the evidence that was in it did more to prove they framed the suspect than it did to show guilt. I’m sure you can guess which case that would be.

I agree, since the Sheriff was arrested - Mickey & Clayton should also be arrested and suspended. They may very well be destroying evidence as we speak...? I have a feeling that all the names u mentioned are in for an unpleasant joyride... lol

"On June 21, Capt. Mickey Boyles called Horner about potential criminal conduct by Clark, Hurley and Chapman, according to the news release. Several days before the call, the sheriff’s office had already interrogated Hurley and Chapman and had attempted to interview Clark, Horner said in the news release.

(Basically, Mickey Boyles had already been involved in investigating them and was trying to talk Horner into bringing bogus charges against them...Or, He was trying to cover his behind after unlawful investigation, whatever, it was illegal and Mickey was aware of it.)

Clark, Hurley and Chapman had gotten a cellphone number and were attempting to get records for that number, which belonged to Melanie Buchanan, Terry Buchanan’s wife. Indictments allege that Terry Buchanan used the same phone to conduct public business.

“Because the Sheriff was identified by Captain Boyles as either a potential witness/victim, it was immediately apparent that a conflict existed within the Ashe County Sheriff’s Office being involved in any way in the investigation,” Horner said in the news release.

(Mickey didn't hesitate investigating the girl for having sex with an inmate, however, in my opinion in that case, he portrayed the inmate in being a victim.. and the girl as having been bad guy..)




It appears to me that Mickey is up to his chin in lies and deceptive practices. From what I heard, he along with Clayton are the two that led the investigation(s) in which the girl was arrested for having sex with an inmate. They may have also threatened to arrest people if they didn't write statements against others..?

Now, lets look at Clayton and his statement to WBTV on June 19th, 2017.

Ashe County Sheriff’s Office Chief Deputy Rick Clayton confirmed an investigation in a phone call Monday afternoon but refused to provide the violation or possible violation of the law being investigated, as required by the Public Records Act.

“It was an administrative investigation that could still potentially be ongoing so there’s not any information at this point,” Clayton said.

Clayton refused to provide any information about the investigation even after a reporter cited to him the specific section of the law that required law enforcement agencies to make public what violation or potential violation of the law they are investigating.

“There’s not a violation of the law that’s been determined at this point,” Clayton said.

When asked by a reporter if he or Buchanan wanted to provide a comment for a story about the sheriff’s office investigating county employees for attempting to provide records responsive to a public records request, Clayton laughed.

I can see Clayton & Mickey brought up on the same charge as the Sheriff.. As a matter of fact, you could also add aiding & abetting (Under the common law doctrine of aiding and abetting, a person is considered to be a principal to a crime when: (1) a crime is committed by another, (2) the person knowingly advises, instigates, encourages, procures, or helps the other person commit the crime, and (3) his or her actions or statements caused or contributed to the commission of the crime by the other person.)

In my opinion - Here is who I think will be bonding next....

The investigation by the NCSBI is ongoing, and further charges or indictments may be forthcoming in the near future.

My concern is bufurt was not in this alone in regards to the illegal investigation into 3 county employees doing their jobs. The county manager sat back, the county attorney sat back all knowing or were told it was illegal. Least we not forget 5 commissioners that also sat back. Then we move on down to the actual officers involved. What if anything will be done with this gang?

John Kilby, the county attorney did not sit back and allow this to happen. He explained the law, and what everyone's duties and responsibilities were. Ann Clark tried to do exactly what she was supposed to do. Roark, Rose, Perry and their sycophant county manager made their own decisions on what they wanted to do. The Sheriff did not like Mr. Kilbys advice and went and hired his own attorney using county funds. No one can lay any part of this at Mr. Kilbys feet.
